Original Application praying that this Hon'ble Court be pleased to pass an order of Interim Injunction, restraining the 2nd Respondent and their subordinates, delegates, agents, executors, assigns and/or anyone claiming under or through them from in any manner from bring any of the pledged immovable properties being Industrial Land bearing Plot No.122/1, out of Shed No.122(NP) with a building having a built up area of 2000 Sq.Ft admeasuring to an extent of 2637.5 Sq.Ft (out of 0.2743 acre) of land and working shed, comprised in Survey No.96 Part and 95 Part of Pattarawakkam Village, Ambattur Industrial Estate, Chennai 600 053 within the Registration District of North Chennai and Sub-Registration District of Ambattur, morefully described in the Judge's Summons for sale. This original application coming on this day before this court for hearing the court made the following order:
Today when the matter was taken up for hearing, learned counsel for the applicant submitted that without intimation, the bank guarantee has been invoked.
2. Learned counsel for the first respondent submitted that the bank guarantee has been invoked long back and the amount has been realised.
