Prayer: Writ Petition under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the respondents 1 and 2 to consider and pass appropriate orders on the petitioner's representations dated 02.03.2026 and 07.04.2026 seeking cancellation of the settlement deed dated 29.02.2024, bearing Doc.No.1866 of 2024 on the file of the Sub-Registrar, Dharapuram, executed by the petitioner in favour of the third respondent in accordance with the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

O R D E R
This Writ Petition has been filed to direct the respondents 1 and 2 to consider the petitioner's representations dated 02.03.2026 and 07.04.2026 seeking cancellation of the settlement deed dated 29.02.2024, bearing Doc.No.1866 of 2024, on the file of the Sub-Registrar, Dharapuram, executed by the petitioner in favour of the third respondent in accordance with the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.
2. The case of the petitioner is that the petitioner is a Senior citizen and farmer. He purchased agricultural land in Survey No.928/2, situated at Munduvelampatti Village, Dharapuram Taluk, Tiruppur District, by way of a registered sale deed Document No.2228 of 2002 on the file of the Sub Registrar, Dharapuram. The third respondent being the son of the petitioner requested the petitioner to settle the aforesaid property in his favour, promising that he would provide food, clothing, shelter and meet the medical expenses to him, his wife
and his daughter. Believing his assurances, the petitioner executed a registered settlement deed dated 29.02.2024 in Document No.1866 of 2024 on the file of the Sub Registrar, Dharapuram. Thereafter, the third respondent failed to honour his assurances and neglected to maintain the petitioner. Therefore, the petitioner made a representation on 02.03.2026 to the first respondent seeking cancellation of the aforesaid settlement deed under the provisions of the Maintenance and Welfare of Parents and Senior Citizens Act, 2007. The petitioner also sent a representation dated 07.04.2026 to the second respondent requesting to take appropriate action in accordance with law, however, no action was taken. Hence, the present writ petition has been filed.
3. The learned counsel appearing for the petitioner submitted that it would suffice, if the respondents are directed to consider the representations of the petitioner dated 02.03.2026 and 07.04.2026 on merits and in accordance with law, within a specified period.
4. Heard the learned counsel appearing for the petitioner and the learned Government Counsel appearing for the respondents 1 and 2. Since no adverse
order is going to be passed against the third respondent, notice to the third respondent is dispensed with.
5. In view of the limited request made by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, directs the respondents to consider the representations of the petitioner dated 02.03.2026 and 07.04.2026 and pass appropriate orders on merits and in accordance with law within a period of 12 weeks from the date of receipt of a copy of this order, after providing opportunity to the third respondent.
6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
