ORDER
The Writ Petition has been filed seeking a direction to the respondents 1 and 2 to take appropriate action on the petitioner's complaint dated 08.03.2026.
2.The contention of the learned counsel for petitioner is that the petitioner is owning a Lorry and Tractor and making his earnings. During the year, 2025, the third respondent approached the petitioner and represented that he has got orders to transport the goods in Trichy Airport and asked the petitioner to give one Tractor on hire basis. Accordingly, the petitioner entrusted the Tractor bearing No.TN-46-AD-7665 to the third respondent and the third respondent agreed to pay Rs.30,000/- per month. Later, the petitioner came to know that the third respondent not only cheated the petitioner but several persons, hence a case in Crime No.68 of 2025 registered by Kanakiliyanallur Police for offence under Sections 406 and 420 of I.P.C. Thereafter, the third respondent was arrested.
In his confession, he admits about taking petitioner's tractor for hire. Thereafter the petitioner approached the Kanakiliyanallur Police seeking to take his complaint and also to return the Tractor but the said police informed to approach the second respondent, since the petitioner's case comes under the jurisdiction of Padalur police station/second respondent herein. Thereafter, the petitioner had given a complaint dated 08.03.2026 to the second respondent. But no action has been taken.
3.The learned Additional Public Prosecutor submitted that petitioner's main allegation is that third respondent has cheated and misappropriated the petitioner's tractor and his earnings. The third respondent was arrested in Crime No.68 of 2025 by Kanakiliyanallur Police and the third respondent admitted taking tractor bearing No.TN-46-AD-7665 from the petitioner. In view of the same, the petitioner can only lodge a complaint with Kanakiliyanallur Police and his complaint forms part of investigation in Crime No.68 of 2025. 4.On the submissions and perusal of the materials, the petitioner is directed to lodge a complaint to the Inspector of Police, Kanakiliyanallur Police Station, Trichy. The Inspector of Police to take the complaint on file, which forms part of the investigation in Crime No.
68 of 2025, record the statement of the petitioner as witness. If the petitioner's Tractor bearing No.TN-46-AD-7665 seized in Crime No.68 of 2025, the same to be returned to the petitioner, of course, if it is produced before the Magistrate, the petitioner to file a return of property petition and collect the same.
