REF CR.NO.17/AC/2003/CC-II DATED 15.10.2003 Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to dispense with the personal appearance of the petitioner before the Trial Court in Special Case No.1 of 2008 on the file of the Special Judge and Chief Judicial Magistrate, Tiruvallur pending disposal of REVISION PETITION IN CRL RC.NO.458 OF 2017[IN CRL MP.NO.4071 OF 2017] Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of MR.A.RAMESH,SENIOR COUNCEL M/S.C.ARUN KUMAR, Advocate[IN BOTH PETITIONS] for the petitioner and of MR.E.RAJA, ADDITIONAL PUBLIC PROSECUTOR on behalf of the Respondents the court made the following order:- These petitions has been filled under section 205 Cr.P.C. to dispense with the personal appearance of the petitioner before the Trial Court in Special Case No.1 of 2008, as the petitioner is aged 85 years.

2. The learned Special Public Prosecutor has no objection for allowing this petition.

3. This Court has perused the averments of the petition and the related records.

4. Being satisfied with the reasons stated therein, this court finds that the petitioner's personal appearance in S.C.No.1 of 2008 may be dispensed with, as she is an octogenarian.

5. With the observation, this petition is allowed and the personal appearance of the petitioner is disposed with. However, the petitioner, is directed to appear before the Court as and when her personal appearance is necessary.

6.Post the revision on 07.04.2017.
