O R D E R

The present criminal original petition has been filed to direct the respondent to register a cse on the petitioner's complaint dated 10.06.2015.

2. The petitioner is the absolute owner of the vacant lands situated at Kattupakkam village, Arakkonam Taluk, Vellore District comprised in Survey Nos.728/1A1, 1A2, 1C2, 728/3 to 7 and 684/4, 686/2 totalling 10 acres 67 cents. The petitioner appointed one V.Murugan, S/o.Veeraragava Pillai, residing at Kunnathur Village and Post, Arakkonam Taluk, Vellore District as his Power Agent to deal with the said properties vide Power of attorney dated 20.09.2010, registered at the Office of SRO Joint-I, Arakkonam as document No.428 of 2010. The said land has been classified as District Collector land which meant that the land should be sold only to persons belonging to SC/ST communities and the same was instructed to the Power Agent. Based on the Power of Attorney, the said Murugan sold the petitioner's property to the tune of Rs. 1 crore between 2010 and May 2015 to the persons belonging to other caste. Thereafter, the petitioner came to know that the said Murugan with the help of Officials attached to the Sub Registrar, Arakkonam sold a large number of housing plots to the ineligible

persons by committing a fraud and misrepresentation. Therefore, the petitioner lodged a complaint before the Superintendent of Police, Vellore District and the same was forwarded to the respondent police. But no action was taken by the respondent on the complaint of the petitioner till date. Hence, the petitioner has come forward with the present criminal original petition.

3. I have heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the respondent.

The learned Additional Public Prosecutor submitted that on receipt of the complaint from the petitioner a detailed enquiry was conducted on the complaint given by the petitioner and the said complaint was closed on the basis of the undertaking given by the parties that they would amicably settle the matter among themselves. He also produced a copy of the closure report before this Court.

5. In view of the submissions made on either side, as the complaint given by the petitioner has already been closed, nothing survives in this petition and this petition is closed with liberty to the petitioner to work out his remedy in the manner known to law.
