Respondent For Applicant : Mr.B. Arvind Srevatsa ------- This Court by its order, dated 21.04.2025 granted an order of interim injunction as prayed for in O.A. No.394 of 2025. The applicant claims that they are the lawful sub tenant under the respondent. According to the applicant, the respondent is trying to evict the applicant without following the due procedure established under law.

2. The learned counsel for the respondent has now made an 1/3

endorsement in the Court bundle stating that only by following the due procedure established under law, the respondent will evict the applicant. He would also submit on instructions that subsequent to the passing of the interim order by this Court on 21.04.2025, the applicant has failed to pay the rent to the respondent. The same is disputed by the applicant.

3. Undoubtedly, a lawful sub tenant can be evicted only by following the due procedure established under law. In view of the well settled law, the respondent shall evict the applicant only by following the due procedure established under law. After recording the endorsement made by the learned counsel for the respondent through which, an undertaking has been given by the respondent that they shall evict the applicant only by following the due procedure established under law, this application is closed. In case, of any violation committed by the respondent, liberty is granted to the applicant to approach this Court once again. The respondent shall file eviction proceedings against the applicant, if they so desire by following the due procedure established under law.
