This writ miscellaneous petition has been filed to direct respondents to release the petitioner's vehicle (Ashok Leyand Bada Dost, Grey Colour) bearing Registration No.TN 91 L 2896, Engine No.CMHO50756P and CHASSIS No.MB1AB42EX MRAS7279 which was seized by the second respondent on 10.01.2023.

2. Heard Mr.S.N.Arun Kumar, learned counsel for the writ petitioner and Mr.S.Vinoth Kumar, learned Government Advocate (Crl.Side), who accepts notice on behalf of both the respondents and he has no objection to give interim custody of the vehicle to the petitioner.

3. The respondents are directed to give interim custody of the vehicle bearing Registration No.TN 91 L 2896, subject to the following conditions: a) The petitioner is directed to pay a sum of Rs.3,000/- (Rupees Three Thousand only) to the credit of the Chief Justice Relief Fund, High Court 1/4

Madras and shall produce the said receipt before the concerned authority. It will be a non-refundable payment.

b) the petitioner is directed to file a fresh representation before the authorities along with the copy of this order. c) The petitioner shall not alienate or encumber the vehicle in question till the proceedings are completed;

d) The petitioner shall produce all documents pertaining to ownership of the seized vehicle; and e) when the respondents call for the vehicle for enquiry, the petitioner has to produce the vehicle in question and he shall cooperate with the enquiry to be conducted by the respondents.

4. Upon completion of these formalities, the respondents shall release the vehicle forthwith without any delay. If aforementioned undertaking given by the petitioner is breached, the petitioner will not be entitled to interim release of the vehicle in future.

5. This Writ Miscellaneous Petition is ordered in aforesaid manner i.e., with aforementioned directive.
