O R D E R
This petition has been filed to direct the first respondent herein viz., the Inspector of Police, M.6 Manali Police Station, Chennai to register a case as against the said persons on her complaint dated 11.12.2015.
2. The petitioner herein has lodged a complaint as against one Mohan, Sekar, Prasanth and Muthu alleging that they have encroached the land belong to the paternal uncle of the petitioner's husband and due to which, an enmity was existing between the petitioner's husband and the said persons for a long time. On 06.01.2015 at 5.30 p.m., when the petitioner's husband went to receive the flood relief, the accused person https://hcservices.ecourts.gov.in/hcservices/
attacked the petitioner's husband. They followed the petitioner's husband and trespassed into the house and again attacked the petitioner's husband with iron rod. Hence, the petitioner lodged a complaint as against the said persons with the respondent police. Since the respondent police has not taken any action so far, the present petition has been filed.
3. The learned Additional Public Prosecutor submitted that the petitioner has sent the complaint only by post. If the petitioner gives a complaint in person along with the wound certificate, necessary action will be taken.
4. Considering the submissions made on either side, this Court directs the petitioner to give a fresh complaint to the first respondent police along with the wound certificate and a copy of this order within a period of one week from the date of receipt of a copy of this order. On receipt of the said complaint, the first respondent police is directed to conduct an enquiry and upon enquiry, if the materials are gathered indicating any cognizable offence, he is directed to proceed further in accordance with law as early as possible.
5. The criminal original petition is disposed of accordingly.
