ORDER
Heard Mr.C.Kalaichelvan, learned counsel for the petitioner. There is no representation on the side of the respondents.
2. The Civil Revision Petition is preferred against the order passed under Order 21 Rules 58 and 58A and 59 of the Code of Civil Procedure, 1908. The said order is appealable under the provisions of the Court and therefore, the revision is not maintainable. The learned counsel for the petitioner seeks liberty to file appropriate appeal against the impugned order.
3. Recording the above submission, this Civil Revision Petition is dismissed. Liberty is granted to file appeal against the impugned order and time consumed in the revision shall be excluded for the purpose of limitation in calculating the period of limitation in filing the appeal. Consequently, connected Miscellaneous Petition is also dismissed. There shall be no order as to costs.
