Petition filed under Article 226 of the Constitution of India for the issuance of writ of certiorarified mandamus, calling for the records of the third respondent culminating in his order R.O.C.No.3548/2014/A dated 17.09.2014 quash the same and also directing the 2nd respondent to reinstate the petitioner into service with all attendant benefits.

O R D E R

The petitioner was suspended by the third respondent by order dated 17.09.2014. The order of suspension is challenged in this writ petition on multiple grounds.

2. The learned counsel for the petitioner submitted that the petitioner would be satisfied in case a direction is issued to the third respondent to review the order of suspension.

3. Heard the learned counsel for the petitioner and the learned Additional Government Pleader on behalf of the respondents.

4. There is no dispute that the order in question was issued only by the Revenue Divisional Officer. The Revenue Divisional Officer suspended the petitioner from service. When it is made out that the Revenue Divisional Officer is having the power to suspend, https://hcservices.ecourts.gov.in/hcservices/

it is implied that he has got the power to review also.

5. The third respondent is directed to consider and dispose of the representation submitted by the petitioner dated 09.01.2015 on merits and as per law. Such exercise shall be completed within a period of four weeks from the date of receipt of a copy of this order.
