ORDER

The writ petition is filed for the relief set out below: "to call for the records relating to Na.Ka.No.1932/2021 Tho.Ve.Sa. dated 13.03.2026 on the file of the 2nd Respondent and quash the same and consequently direct the 1st Respondents to consider the petitioners application dated 07.06.2021 and appoint the petitioner in the 3rd Respondent institution."

It is the case of the petitioner that his late father was appointed as a Salesman in the third respondent Society on 20.08.1993 and after a brief interruption, he was reappointed on 23.07.2014 and continued the service till his death on 29.12.2019. After his demise, the petitioner submitted an application dated 07.06.2021 seeking appointment on compassionate grounds, which was rejected by the second respondent by the impugned order dated 13.03.2026 on the ground that the petitioner's father's service has not been regularized by the respondents. Therefore, aggrieved petitioner is before this Court.

3. Heard the learned counsel on either side and perused the materials available on record.

4. The petitioner's father had put in service from the year 1980 which is over a period of 10 years which fact has not been taken note of by the respondents. The petitioner's father ought to have been regularized on his completing 10 years of service. The petitioner has not been given a hearing and the impugned order suffers from non-application of mind. Since, the principles of natural justice have not been followed, the impugned order stands quashed and the matter is remitted back to the first respondent. Considering the relief now sought for by the learned counsel for the petitioner, this Court, without going into the merits of the case, directs the first respondent to consider the petitioner's application dated 07.06.2021 afresh, on merits and in accordance with law and to pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.
