Petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus to direct the first respondent to lock, seal and demolish the unauthorised construction done by the second respondent at Door No.6 Lazarus Church Road, Raja Annamalaipuram, Chennai 28 under the provision of the Town and Country Planning Act, 1971 as amended by Act 61 of 2008, by considering the petitioner's representation dated 9/4/2013.

(delivered by SATISH K.AGNIHOTRI,J) On the last occasion, i.e., on 13 October 2015, on the request of the learned counsel for the petitioners, a Commission was decided to be constituted on deposit of a sum of Rs.1 lakh https://hcservices.ecourts.gov.in/hcservices/
(Rupees One lakh only) within a period of one week from the date of the said order.
2. Today, when the matter was called in the first round, there was no representation on behalf of the petitioners. Hence, the matter was passed over. Again, when the matter was called in the second round, none appeared on behalf of the petitioners nor was there any representation made on their behalf to prosecute the matter. We are informed that no deposit has been made by the petitioners as directed by this Court on 13 October 2015. Thus, this writ Petition is dismissed for non-prosecution. No costs.
