The petitioner/A4, who was arrested and remanded to judicial custody on 03.04.2024, pursuant to the Non-Bailable Warrant of arrest issued against him in S.C.No.214 of 2023 pending on the file of the learned Principal District and Sessions Judge, Cuddalore in connection with Crime No.331 of 2022 registered for the offences under Sections 147,148, 302, 120B, 450 and 342 of IPC, seeks bail.

Learned counsel for the petitioner submitted that the petitioner is an accused facing trial in S.C.No.214 of 2023, pending on the file of the learned Principal District and Sessions Judge, Cuddalore. He further submitted that due to the illness, the petitioner was unable to appear before the trial Court on 29.11.2023, whereas, he was issued with the non-bailable warrant of arrest and pursuant to the same, he was arrested on 03.04.2024. He also submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court and therefore, he prayed for grant of bail to the petitioner.

Learned Government Advocate (Crl.Side) appearing for the respondent submitted raised objection stating that since the petitioner, who is an accused facing trial in S.C.No.214 of 2023, on the file of the learned Principal District and Sessions Judge, Cuddalore, has failed to appear before the trial Court, he was arrested on 03.04.2024 pursuant to the NBW issued against him. https://www.mhc.tn.gov.in/judis

He further submitted that four previous cases including the cases registered for the offence under Section 302 IPC are pending against the petitioner, therefore, if he is released on bail, there is a possibility of him absconding again and will derail the progress of trial. Hence, he raised objection for allowing the petition.
5. Considering the submissions made by the learned Government Advocate (Crl.Side) and also considering the previous antecedents of the petitioner, this Court is not inclined to grant bail to the petitioner.
