ORDER

The petitioner, who was arrested on 18.02.2026 and remanded to judicial custody on 03.03.2026 for the alleged offences under Sections 316(2), 318(4) of BNS Act (Section 405 & 415 of Indian Penal Code, 1860, in Crime No.4 of 2026 on the file of the respondent police, seeks bail.

The case of the prosecution is that the petitioner, acting as Purchase Manager of ABM Traders, induced the defacto complainant to supply goods worth Rs.12,07,500/- and received Rs.4,00,000/- and thereafter cheated the complainant. It is further alleged that the petitioner has cheated several persons to the tune of Rs.1,87,05,380/- by similar transactions. Hence, the case was registered.

The learned counsel appearing for the petitioner submitted that the petitioner is innocent and he has been falsely implicated in this case and he is not responsible for the day-to-day affairs of the firm. It is further submitted that there was delay in producing the petitioner before the Court and he has been in custody. It is also brought to the notice of this Court that the co-accused was granted bail by this Court. It is his specific submission that the petitioner is ready to abide by any stringent conditions imposed by this Court. Hence, he prays for the grant of bail to the petitioner.

The learned Government Advocate (Crl.Side) appearing for the respondent submitted that the petitioner is a habitual offender and was earlier involved in serious cases including bomb blast case and has been in incarceration. It is further submitted that the petitioner has cheated several persons to the tune of Rs.1.87 crores and is involved in multiple offences. Hence, he opposed to grant bail to the petitioner.

5. I have given anxious consideration to the submissions made by the learned counsel on either side.

6. This Court is of the view that considering the criminal antecedents of the petitioner and the magnitude of the offence involving cheating of several persons, this Court is not inclined to grant bail to the petitioner.
