This petition has been filed to direct the learned IX Metropolitan Magistrate, Saidapet, to expedite the trial in C.C.No.12/14 by fixing the time limit by this Court.
2. The petitioner is a Software Engineer and working in U.S.A. He obtained US citizenship on 11.11.2013 and he has been in USA for more than 8 years. The marriage between the petitioner and one Rekha took place on 02.02.2014 in accordance with Hindu rites and customs. Before marriage, the petitioner was working in U.S.A. and after marriage, the petitioner had stayed in India for 9 months and worked from Home for US employer for a period of 6 months. The said Rekha, wife of the petitioner has obtained a decree for divorce from her 1st husband. The respondent police has laid a final report in C.C.No.12/2014 on the file of the 9th Metropolitan Magistrate Court, Saidapet, Chennai, for the offence under sections 498(A), 417 and 406 of IPC for dowry harassment against this https://hcservices.ecourts.gov.in/hcservices/
petitioner. Now, the petitioner has come forward with the present petition stating that he is a US citizen and he is working there and he could not travel frequently to India and his livelihood is based on his employment in USA and he could not stay for long period in India.
3. Heard, the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.
4. Considering the submissions made on either side, this Court directs the learned IX Metropolitan Magistrate, Saidapet, Chennai, to expedite the trial in C.C.No.12/14 on its file and complete the same as early as possible.
5. The criminal original petition is disposed of accordingly. Consequently, connected miscellaneous petitions are closed.
