Respondents PRAYER: Petition filed under Section 11 of the Contempt of Courts Act, to punish the respondents for their willful and deliberate disobedience of the order of this Court made in WP. No.22339 of 2019 dated 26.08.2019 causing Contempt of Court.

ORDER

This petition has been filed to punish the respondents for their willful and deliberate disobedience of the order of this Court made in WP. No.22339 of 2019 dated 26.08.2019 2.The learned Additional Public Prosecutor on instructions submitted that the final report was filed before the Special Court, Erode for an offence under Section 306 IPC and Section 3 of the SC/ST Act and the same has been taken on file in Spl.S.C.No.24 of 2020. The learned counsel further submitted that the case has now been posted on 03.02.2021. Mr.Kannan, Inspector of Police was also present at the time of hearing through video conferencing.

3.The learned counsel for the petitioner submitted that the RDO Report reveals the fact that it is a case of murder and in spite of the same, a final report has been filed under Section 306 IPC. 4.In the considered view of this Court, the Special Court will take into consideration all the materials placed before it at the time of framing the

charges. Therefore, no further orders can be passed in this contempt petition and same is closed.
