PRAYER : This petition has been filed to modify the condition on the petitioner in Para.No.6(b) in Crl.OP.No.28706 of 2023 dated 11.01.2024. For Petitioner : Mr.K.Balasubramaniam For Respondent : Mr.C.Baskaran Government Advocate (Crl.Side) 1/4

O R D E R

The present petition has been filed to modify one of the conditions in paragraph No.6(b) that the petitioner should appear before the concerned Court on all hearing dates. Apart from that the petitioner is directed to appear on every Monday before the concerned Court till the completion of trial.

2. The learned counsel for the petitioner has submitted that as per the order of this Court, the petitioner had executed sureties before the Additional District Judge, EC Court at Coimbatore and appeared before the Additional District Judge, EC Court at Coimbatore on all hearing dates. Apart from that, he had appeared on every Monday before the concerned Court from 12.01.2024. He further submitted that due to the condition imposed on the petitioner, the petitioner is unable to attend normal duties and family affair. Hence, he seeks modification.

3. Heard the learned Government Advocate (Crl.Side) appearing for the respondent police.

Considering the facts and circumstances of the case and the submissions made by counsel on either side, the condition imposed in para No.6(b) in Crl.OP.No.28706 of 2025, dated 11.01.2024, is modified to the effect that " the petitioner shall appear before the concerned court below with regard to C.C.No.1 of 2024 on all hearing dates without fail". Except the above modification, all other conditions shall remain intact.

5. With the above modification, this Criminal Miscellaneous Petition is allowed.
