This petition has been filed to direct the respondent police to register a First Information Report on the basis of the petitioner's complaint dated 19.06.2015, for which, a receipt has been issued in Petition No.227/15 dated 24.06.2015.
2. The petitioner lodged a complaint as against one G.Suganya, D/o.Ganesan and 4 others stating that the petitioner married Suganya on 18.1.2013 in January, 2013. Though they got married, the said Suganya remained in her parents place. On 18.6.2015, the petitioner came to know that Suganya got married with another person. When the petitioner questioned the same, he was assaulted by Suganya's father and others. They also gave a false complaint against the petitioner. The petitioner also gave complaint against Suganya, Ganesan, Jayanthi, Logesh and Saraswathi, on 19.6.2015 before the respondent police. Since no action was taken so far, the present petition has been filed. https://hcservices.ecourts.gov.in/hcservices/
3. Learned Additional Public Prosecutor submitted that allegation made in the complaint of the petitioner do not constitute cognizable offence. Hence, he opposed the grant of direction. However, he submitted that on the complaint given by the petitioner, C.S.R.No.227/2015 has been assigned and petition enquiry is pending.
4. Since C.S.R. number has been assigned, this Court directs the respondent police to conduct an enquiry in C.S.R.No.227/2015 and upon enquiry, if the materials are gathered indicating any cognizable offence, he is directed to proceed further in accordance with law as early as possible.
5. The criminal original petition is disposed of accordingly.
