ORDER : The Court Made the following order :- The petitioner, who apprehend arrest at the hands of the respondent police for the alleged offence under Sections 292(A), 499, 500 and 503 of IPC r/w Section 67 of Information Technology Act, 2000 in Crime No.258 of 2021, on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the defacto complainant uploaded pictures in social media, which shows that some political leaders were sitting with one lady. It is alleged that in order to defame the political personalities the petitioner had posted the obscene pictures. Hence the law enforcing agency registered a case against the petitioner.

3.The learned counsel appearing for the petitioner would submit that the petitioner is not the author of the picture and he has just forwarded the message to his friends. Hence, he prays for grant of anticipatory bail to the petitioner.

5. The learned Government Advocate would submit that the act of the petitioner in passing obscene message is not justifiable. Hence ,he opposed for grant of anticipatory bail to the petitioner.

6. Taking into consideration the facts of the case and the nature of offence committed by the petitioner, this Court is not inclined to grant anticipatory bail to the petitioner.
