ORDER

Petitioner has come forward with the present petition seeking to register the petitioner's complaint dated 08.06.2015 pending in CSR.No.291 of 2015.

2. It is the case of the petitioner that he is the holder of the Credit Card bearing No.4328080200258662 with the Indian Bank, High Court Branch for the past 6 years and till date, the petitioner is prompt in paying the necessary charges as per the Bank norms. While so, to his shock and surprise, the petitioner received a message in his mobile phone on 08.06.2015 at 18.25 hours that a sum of Rs.12,100/- was illegally taken from his card at Chandi MAA Emporium, Gandhi Nagar. On contacting the customer care service, the petitioner was advised to contact the toll

free number through IVR method and the petitioner had blocked the card and he also received the confirmation message. It is the further case of the petitioner that in order to retrieve the amount illegally taken from his card, he sent a detailed mail to the Customer Care Executive and requested to take immediately action on the fraud committed. The petitioner received a reply from the Customer Care Executive to the effect that a complaint may be lodged before the local jurisdiction regarding the fraud committed on the petitioner's credit card. Upon approaching the respondent police and lodging a complaint on 08.06.2015, though CSR No.291/2015 was assigned on 09.06.2015; but till date the respondent police has not taken any action on the said complaint and hence, the petitioner has approached this Court by way of filing the above petition.

3.Learned Additional Public Prosecutor would submit that suitable direction may be given to the first respondent police to register the complaint.

4. In view of the submission made by the learned Additional Public Prosecutor, this Criminal Original Petition is disposed of with the direction to the first respondent police to conduct enquiry and register the complaint and proceed further in accordance with law as early as possible.
