ORDER

Petitioner has come forward with the present petition seeking to register the his complaint dated 10.10.2015.

2. Petitioner being a social activist person and circle secretary in a leading political party had started Thiyagi Chinnasamy Ninauvu Mandram along with others at No.39, Ezhil Nagar, 'B' Block, Chennai wherein they were running tuition classes, free afternoon meals on sundays and other welfare activities. It is the further case of the petitioner that one Panchali who is the neighbour to that said Mandram is disturbing the smooth functioning of the same. She also fraudulently impersonated as if she is the owner of the land pertains to the said Mandram and executed a false sale deed in favour of one Bakkalakshmi w/o Eswarabalan. It is further alleged that on 10.10.2015, some unknown persons trespassed into the Mandram and damaged the articles of the same. Hence, he lodged a complaint with the respondent police and since no action had been taken so far, the present petition has been filed.

3. Learned Additional Public Prosecutor submitted that on receipt of the complaint, CSR.No. 836 of 2015 was assigned and the matter is pending enquiry.

4. Since already CSR No.836 of 2015 was assigned on the complaint given by the petitioner, the respondent police is directed to conduct an enquiry and upon enquiry, if the materials are gathered indicating any cognizable offence, he is directed to proceed further in accordance with law as early as possible. In the course of enquiry, if no prima facie is made out or the matter is civil in nature, he is directed to pass appropriate orders on the complaint made by the petitioner.

5. The criminal original petition is disposed of accordingly.
