O R D E R
The petitioner submits that he has the benefit of the interim order of injunction in I.A. No. 227 of 2016 in O.S. No. 54 of 2016 passed by the learned Additional Sub Judge, Chengalpattu with regard to his property situated in Survey No. 346/2A3A1 (whole survey no. 346/2) in Tiruvidanthai, Kelambakkam Sub Registrar District, Tiruporur Taluk, Kancheepuram District. The said order of interim injunction has also been made absolute on 16.02.2017. However, the petitioner apprehends that the defendants in the said suit who are respondents 4 to 7 herein are still creating obstructions for the petitioner to put up compound wall in his property.
2. In view of the order of injunction granted by the Civil Court, the respondent police are bound to give protection to the petitioner for the purpose of putting up a compound wall in his property. Hence, the petitioner is granted liberty to approach the 3rd respondent police with a representation, along with a copy of the order of interim injunction granted by the civil court, seeking for police protection.
3. On receipt of such representation, the 3rd respondent police shall extend the necessary protection to the petitioner for the purpose for putting up compound wall in his property situated in Survey No.346/2A3A1 (whole survey no. 346/2).
With these observations and directions, the Criminal Original Petition stands allowed.
