ORDER

This petition has been filed seeking a direction to direct the respondent to register the complaint dated 07.08.2015.

2. Petitioner herein lodged a complaint as against one Chandran alleging that the same Chandran had encroached upon 3 cents of the petitioner's land and threatened him with dare consequences. Though the said complaint has been assigned as CSR.No.436 of 2015, no action was taken so far. Hence, the petitioner is before this Court.

3. Learned Additional Public Prosecutor would submit that in the aforesaid complaint no details with regard to the survey number in which the alleged encroachment has been made was given and hence, he would submit that the petitioner may be directed to furnish necessary particulars to the respondent.

4. In view of the submission made by the learned Additional Public Prosecutor, the petitioner is directed to give all necessary particulars to the respondent police and on receipt of the same, the respondent is hereby directed to conduct enquiry on the complaint and upon enquiry, if the materials are gathered indicating any cognizable offence, he is https://hcservices.ecourts.gov.in/hcservices/

directed to proceed further in accordance with law as early as possible. In the course of enquiry, if no prima facie is made out or the matter is civil in nature, he is directed to pass appropriate orders on the complaint made by the petitioner.

5. The criminal original petition is disposed of accordingly.
