O R D E R
This revision arises against the order of challenges the order of learned Sub Judge, Poonamallee, passed in I.A.No.128/2015 in H.M.O.P.No.15 of 2015 dated 12.01.2016.
2. Heard the learned counsel for petitioner.
3. The petitioner/husband filed H.M.O.P.No.15 of 2015 before the Sub Court, Poonamallee, seeking divorce. Respondent/wife filed I.A.No.128 of 2015 seeking interim maintenance. The Court below has held a sum of Rs.5,000/- per month payable as interim maintenance to the respondent/wife.
4. Learned counsel for petitioner submits that the petitioner is a research student who has no means of income. Though, the Court below has rightly recorded the said contentions of the petitioner, it erroneously noted that the petitioner himself admitted to having a income of Rs.25,000/- per month and as a consequence rendered an erroneous finding.
5. On perusal of the order under challenge, we find that the Court below has entered upon a detailed factual discussion and the observation that the petitioner was earning a sum of Rs.25,000/- can only be seen as a slip. We find that the petitioner belongs to upper middle strata of society and a direction to him to pay a sum of Rs.5,000/- per month by way of interim maintenance cannot be seen to be excessive.
6. In the circumstances, the order of the Court below is a proper one and this Court would not interfere. The Civil Revision Petition is dismissed. No costs. Connected miscellaneous petition is closed. 27.06.2016 Index:yes/no Internet:yes To The Sub Judge, Poonamallee
