Respondents Writ petition filed under Article 226 of the Constitution of India praying for the issuance of a writ of mandamus to direct the second respondent to dispose of the representation of the petitioner dated 05.03.2016 and to adjust the credit of Rs.8,000/- [Rupees eight thousand only] which has been enlisted as missing credit for the month of August 2009 along with the interest in GPF Account vide A/C.No.Pol/10717 within a time frame. By consent, the writ petition is taken up and disposed of at the admission stage itself.
2. Mr.A.Kumar, learned Special Government Pleader accepts notice on behalf of respondents 1 and 5 and Mr.Vijay Shankar, learned counsel accepts notice on behalf of respondents 2 to 4.
3. The prayer in the writ petition is for the issuance of writ of mandamus to direct the second respondent to consider the petitioner's representation dated 05.03.2016 and to adjust the credit of Rs.8,000/- [Rupees eight thousand only] which has been enlisted as missing credit for the month of August 2009 along with interest in his GPF Account vide A/C.No.Pol/10717 within a time frame.
4. The case of the petitioner is that he is a retired Sub Inspector of Police. According to the petitioner, he was the subscriber to the General Provident Fund while in service. It is his further contention that a sum of Rs.8,000/- was shown as missing credit in the Account Slip for the year 2010-2011. Therefore, he made several representations to the authorities concerned for rectifying the said defect. Though he received a copy of the communication dated 10.01.2012, which was addressed to the fifth respondent by the second respondent stating the missing credit details, till date the same has not been given effect. In this regard, he had once again submitted a representation dated 05.03.2016 to the second respondent to consider his request. However, till date the same was not considered. Hence the present writ petition.
5. The learned Standing Counsel appearing on behalf of the respondent-Principal Accountant General, would submit that the second respondent is the authority concerned to consider the representation of the petitioner and he has got no serious objection to consider and pass orders on the same.
6. Taking into consideration of the limited prayer, especially, to consider the representation of the petitioner, dated 05.03.2016, this Court without expressing any opinion on the merits of the matter, directs the respondents to consider the representation submitted by the petitioner dated 05.03.2016 and pass orders on merits and in accordance with law, within a period of two months from the date of receipt of a copy of this order, as the petitioner is a Senior Citizen, who has retired four years ago.
7. With the above direction, this Writ Petition is disposed of. No costs.
