O R D E R

The present criminal original petition has been filed seeking a direction to the trial Court to dispose of the C.C.No.382 of 2013 pending on the file of the Judicial Magistrate, Kangayam on merits in accordance with law and allow the petition.

2. In view of the direction sought by the petitioner and in view of the nature of the order going to be passed by this Court, there is no need to issue notice to the respondent.

3. The petitioner filed a complaint against the respondent herein for offence under section 138 r/w.142 of Negotiable Instruments Act before the Judicial Magistrate, Kangayam on 19.08.2013. The same was taken on file and numbered as C.C.382 of 2013. On receipt of summons, the respondent has also entered appearance in the case. The evidence on the side of the complainant was closed as early as on 17.04.2014. Thereafter, the case was posted for the defence side evidence. Subsequently, the matter was periodically adjourned for the past one year for the defence side evidence.

In view of the submission of the learned counsel for the petitioner, this Court directs the learned Judicial Magistrate, Kangayam to expedite the disposal of the case in C.C.No.382 of 2013 as early as possible, preferably within a period of three months from the date of receipt of a copy of this Order.

The Criminal Original Petition is ordered accordingly.
