Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying to issue a Writ of Mandamus, directing the Respondents to consider the Representation dated 30.12.2024 of the Petitioner and consequently direct the Respondents to check, verify and locate our land measuring 39 cents comprised in S.No.414/1B, at Varadharajapuram Village, Kundrathur Taluk, Kancheepuram District, as per the Title Deeds and Patta No.18316 and issue a revised FMB and grant such other order.

ORDER

The present writ petition is filed praying for a writ of mandamus to direct the respondents to consider the petitioner's representation dated 30.12.2024 and consequently direct the respondents to check, verify and locate petitioner's land comprised in S.No.414/1B, measuring an extent of 39 cents, situated at Varadharajapuram Village, Kundrathur Taluk, Kancheepuram District, as per the Title Deeds and Patta No.18316 and to issue a revised FMB .

2.It is submitted by the learned counsel for the petitioner that petitioner is the absolute owner of the property comprised in S.No.414, measuring an extent of 1 acre 55 cents, situated at Varadharajapuram Village. The above mentioned property was acquired vide Sale Deed dated 16.12.1992, registered as Document No.6519 of 1992 before the Sub Registrar Office, Tambaram. Since then, petitioner has been in continuous possession and enjoyment of the said property. It is submitted that there is a material discrepancy between physical features on the ground and dimensions and boundaries as recorded in FMB. Therefore, petitioner submitted a representation dated 30.12.2024 to the respondents seeking comprehensive survey and necessary rectification of revenue records. However, the said representation has not been considered by respondents till date. Aggrieved by the same, the petitioner has come before this Court.

When the matter came up earlier, inasmuch as correction of FMB could be carried out by the Assistant Director of Survey and Land Records, Kancheepuram and Chengalpattu, this Court suo moto impleaded the Assistant Director of Survey and Land Records, Kancheepuram and Chengalpattu as 4th respondent to dispose of this writ petition.

4.At the outset, it is submitted by the learned Additional Government Pleader for respondents would submit that petitioner's representation dated 30.12.2024 would be considered and appropriate orders would be passed within a time frame to be fixed by this Court, which was agreed to by the learned counsel for petitioner. 5.Considering the facts and circumstances of the case and the limited relief sought for in this Writ Petition, there shall be a direction to 4th respondent, to consider the representation on its own merits and pass appropriate orders in accordance with law, after affording reasonable opportunity of hearing to the petitioner, and any other interested persons/rival claimants, within a period of 16 weeks from the date of uploading of web copy of the order. It is made clear that this Court has not expressed any views with regard to the merits of the representation and it is open to the concerned respondent to consider the petition on its own merits and in accordance with law.
