This Civil Miscellaneous Petition has been filed seeking to condone the delay of 304 days in filing the above Civil Miscellaneous Appeal.

2. Since the 1st respondent remained exparte, notice to the 1st respondent is dispensed with.

3. Mr.A.Sundaravadhanam, learned counsel takes notice for the 2nd respondent and he has not raised any serious objection in allowing the above petition to condone the delay.

4. Considering the facts and circumstances, and being satisfied with the reasons stated in the affidavit filed in support of the petition, the delay in filing the appeal is condoned and the petition is ordered on condition that, in the event of appeal is being allowed, the appellant is not entitled for interest for the default period. Registry is directed to number the appeal, if the papers are otherwise in order and also directed to print the name of Mr.A.Sundaravadhanam, learned counsel appearing for 2nd respondent in the cause list.
