ORDER

(Order of the Court was made by the Hon'ble Chief Justice) Counsel for petitioner, in fairness, stated that second appeal before first respondent is pending and he filed this petition in view of the delay in disposal of the said appeal by first respondent.

2. Ms.Srivadivu states the said appeal has been numbered on 1 st November, 2023 as S.A.No.19042/A/2023. Ms.Srivadivu also states that presently appeals numbered in 2022 are being heard and, according to her estimate, this appeal shall be disposed of within three months.

3. In view of the statement made by first respondent, which is recorded as an undertaking to this Court, Shri Vadiraj Anirudh seeks leave to withdraw the petition.

4. Petition is dismissed as withdrawn. There shall be no order as to costs.
