amount at the rate of 6 percentage per annum for 9 months of delayed payment in the light of the judgment passed by this Hon'ble Court on 23.10.2024 in W.P.No.30766 of 2024".

2. The brief facts which has culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioners that they was working Junior Assistant and Junior Engineer in the respondent Corporation and retired from service on attaining the age of superannuation. The respondents settled the Service Gratuity, Provident Fund, Leave Salary and Commutation of Pension amount with a delay of nine months to the petitioners. Therefore, the respondents are legally bound to pay interest to the petitioners. Therefore, the petitioners made a representation to the respondents to pay the interest at the rate of 6% p.a., for the belated payment of the petitioner's Service Gratuity, Provident Fund, Leave Salary and Commutation of Pension amount. Since there is no response, the petitioners are before this Court.

3. Heard the learned Counsel on either side and perused the materials available on records.

4. Admittedly, the Service Gratuity, Provident Fund, Leave Salary and Commutation of Pension amount has been paid belatedly for no fault of the petitioners. Therefore, the petitioners are entitled to interest on the same. Therefore, the Writ petitions are allowed as prayed for and a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Service Gratuity, Provident Fund, Leave Salary and Commutation of Pension amount to the petitioners within a period of one (1) month from the date of receipt of a copy of this order. No costs.
