Respondent Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking for a writ of mandamus directing respondent to consider the petitioner appeal dated 13.08.2013 preferred before against the order of the District Manager in Say.Mu.Ka.No.A6/8899/2014 dated 16.05.2015 thereby directing the respondent to dispose off the appeal in a time period. By consent, the writ petition is taken up for final disposal. The petitioner was appointed as a Salesman in the services of the Tamilnadu State Marketing Corporation Limited [TASMAC] on 07.11.2003 and thereafter, transferred to various shops between 20032014 and while he was working as Salesman in Shop No.8899 during November 2014, a surprise raid was conducted and the petitioner was charged with the allegations of shortage, mixing of water and loose sales and a criminal prosecution was also launched against him in the form of FIR and the petitioner was arrested and enlarged on bail. The disciplinary action was also initiated against him which culminated into order of termination on 16.07.2015 passed by the District Manager. The petitioner aggrieved by the order of dismissal, filed departmental appeal before the respondent on 13.08.2015 and though it was received and acknowledged on 17.08.2015, no orders have been passed and hence, the petitioner came forward to file this writ petition.

Heard the submissions of the learned counsel for the petitioner and Mr.S.Muthuraj, learned counsel who accepts notice on behalf of the respondents.
This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the same, directs the respondent to consider and dispose of the petitioner's appeal petition dated 13.08.2015 on merits and in accordance with law and pass orders within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken to the petitioner.
