This Civil Miscellaneous Petition has been filed to grant leave to the petitioners to institute the present Revision Petition before this Court.
2. The Civil Revision Petition has been filed to set aside the judgment and decree dated 25.02.2021 in A.S.No.15 of 2020 on the file of the VI Additional City Civil Court, Chennai, reversing the decree and judgment passed in O.S.No.5317 of 2011 dated 17.10.2019 on the file of VII Assistant City Civil Court, Chennai.
3. The petitioners are not the parties to the suit proceedings and the first appeal suit proceedings. It is seen that their property is sought to be locked and sealed citing the judgment of the Appellate Court in A.S.No.15 of 2020 dated 25.02.2021. They also stated that a Writ Petition has also been filed in W.P.No.8797 of 2023. The said Petition was also disposed of without hearing the petitioners herein.
4. This Court has perused the grounds stated in the Revision Petition. It prima facie appears that serious prejudice would be caused to the petitioners, if further proceedings or action is taken in furtherance of the judgment and decree in A.S.No.15 of 2020 and the orders passed in W.P.No.8797 of 2023, behind the back of the petitioners herein. interest of justice, it would be appropriate to grant leave to the petitioners to institute the Civil Revision Petition before this Court.
