Application No.3672 of 2019 KRISHNAN RAMASAMY, J., This Application has been filed seeking to grant leave to sue the defendant/respondent Nos.1 to 3, 5 to 14, 16 to 30, 33, 35 to 37 before this Court.

2.1. The learned counsel appearing for the applicant submitted that the applicant's latest venture is the cinematographic film titled, "Bharat" in Hindi language. He would also submit that the trailer and promotion materials related to the said motion picture/cinematographic film was released on the Internet all over the world, including Chennai, which is within the jurisdiction of this Court and the motion picture/cinematographic work of applicant would be further promoted and communicated in theatres all over India including Chennai.

2.2. The learned counsel further submitted that the websites and web pages of the respondents are freely accessible and the unauthorised copies of applicant's motion pictures/cinematographic works are allowed to be uploaded/downloaded or communicated to general public all over India including Chennai and therefore, the cause of action has arisen within the jurisdiction of this Court. He also stated that since the respondent nos.1 to 3, 5 to 14, 16 to 30, 33, 35 to 37 are residing and carrying on the business outside the jurisdiction of this Court, the present Application has been filed seeking leave to sue

The learned counsel further stated that the cause of action has arisen at Chennai as the applicant's movie is accessed, downloaded, uploaded, etc., through Internet all over India including the city of Chennai which is well within the jurisdiction of this Court.

3. Having been satisfied with the reasons stated in the affidavit filed in support of the Application, this Application is ordered as prayed for.
