Prayer: Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Mandamus directing the respondents 1 to 3 to take necessary action on the petitioner's representation dated 14.06.2021 and direct the respondent 1 to 3 herein to cancel Patta in Patta No. 16 issued by the 3rd respondent in favour of the 4 to 9th respondents. ORDER

(Made by the Hon'ble Chief Justice) The grievance of the petitioner is that he has carried a representation to respondent Nos.1 to 3 pertaining to a patta granted in favour of the private respondent Nos.4 to 9, but such representation has not been dealt with.

2. Mr.P.Muthukumar, learned counsel, appearing for the official respondent Nos.1 to 3, submits that the second respondent Revenue Divisional Officer would be the appropriate person to consider the petitioner's representation.

3. In view of such fair submission made on behalf of the official respondents, the petitioner is permitted to carry a fresh, detailed representation in writing to the second respondent within a fortnight from date. Upon receipt of such representation, the second respondent will conduct an inquiry by giving an opportunity of hearing to all who may be affected by his order, including the private respondent Nos.4 to 9 herein. The second respondent should pass a reasoned order following the inquiry within ten weeks of the receipt of the petitioner's representation.

4. Since the merits of the matter have not been gone into and the second respondent has been directed to afford an opportunity of hearing to the private respondent Nos.4 to 9, this writ petition is disposed of without previous notice to the respondent Nos. 4 to 9. However, the petitioner should immediately forward copies of the petition and this order to respondent Nos.4 to 9.

W.P.No.16018 of 2021 is disposed of without any order as to costs.
