Prayer : Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the 4th respondent to handover all the original educational qualification certificates that were deposited by the petitioner at the time of admission into the 4th 1/4

respondent's College and the Original Master Degree Certificate of the Petitioner.

ORDER

This writ petition has been filed for a Mandamus seeking for return of the original certificates back to the petitioner on the ground that no posting order was issued to the petitioner, even after the lapse of two years.

2. Heard Mr.S. Senthil, learned counsel for the petitioner and Mr.T.Seenivasan, learned Special Government Pleader appearing for the respondents.

3. The learned Special Government Pleader appearing for the respondents has placed before this Court, the instructions received by him from the respondents stating that since no posting orders have been issued to the petitioner, the original certificates will have to be returned back to the petitioner. The said instructions are recorded. 2/4

4. Accordingly, this Court directs the respondents to return the original certificates back to the petitioner, within a period of two weeks from the date of receipt of a copy of this order.

5. At the time of getting back the original certificates the petitioner will have to give an undertaking letter that he shall join duty as and when called by the respondents on an emergency basis.

6. With the aforesaid direction, this writ petition stands disposed of. No costs.
