This application is filed to condone the delay. The suit is filed for partition by the father as against the son.

It is the contention of the learned counsel for the applicant that there were talks of compromise and hence there was a delay. 3.

Though the delay is inordinate and each day's delay has to be explained, taking note of the nature of the suit filed by the father, the delay cannot be pitted against the party to defeat the substantial cause.
