Petitioner Vs.
The Managing Director, Chennai Metropolitan Water Supply Sewerage Board, No.1, Pumping Station Road, Chindadripet, Chennai-600 002.
..
Respondents Writ Petition filed under Article 226 of the Constitution of India, praying for the issue of a Writ of Mandamus, directing the respondent to consider the petitioner's claim for promotion for the post of Senior Accounts Officer for the period 2015 to 2016 with effect from 26.2.2016 and decide and pay all other service benefits attached to the post.
For Petitioner : Mr.S.Udayakumar For Respondent : Mr.V.Perumal
O R D E R
Petitioner seeks only for consideration of her representations dated 10.3.2016 and 15.3.2016. According to her, in the earlier list, her name was recommended for promotion. But unfortunately, though the list was prepared on 1.3.2016, as stated by the respondent, she retired on 26.2.2016 itself.
2. Heard Mr.S.Udayakumar, learned counsel for the petitioner and Mr.V.Perumal, learned counsel for the respondent. B.RAJENDRAN, J.
3. It is the only contention of the learned counsel for the petitioner that at least her representations dated 10.3.2016 and 15.3.2016 may be considered and the benefit of granting exemption could be granted in spite of her retirement. https://hcservices.ecourts.gov.in/hcservices/
4. The learned counsel for the respondent would contend that even in the previous selection, she was not eligible. Even at this point of time, when the list was drawn on 1.3.2016, she is not eligible since she retired on 26.2.2016 itself.
5. Taking into consideration of the limited scope involved in this writ petition as to whether at all she is eligible, without expressing any opinion on the merits, the writ petition is disposed of, directing the respondent to consider the representations of the petitioner dated 10.3.2016 and 15.3.2016, on merits and pass appropriate orders thereon in accordance with law, within a period of three months from the date of receipt of a copy of this order. No costs. Consequently, connected miscellaneous petition is closed.
