JUDGMENT

The appeal has been filed by the de-facto complainant/PW1 seeking to set aside the judgment of acquittal passed by the learned Sessions Judge, Special Court under POCSO Act, Nagapattinam, Nagapattinam District in Special Sessions Case No.32 of 2020, dated 13.04.2022. 2.The learned counsel for the appellant submitted that the accused/Veerabalan, S/o.Kandasala Manoharan is no more and nothing survives in the appeal for adjudication.

3.The learned Additional Public Prosecutor produced the death certificate of Veerabalan, confirming that the said Veerabalan died on 26.01.2025 and the Death Certificate is extracted hereunder: 2/5

4. In view of the same, nothing survives for adjudication in this appeal. Hence, the Criminal Appeal is dismissed, as the 2 nd respondent reported to be dead.
