Prayer: Writ petition filed under Section 226 of the Constitution of India seeking to issue a writ of Certiorari to call for the entire records relating to the impugned proceedings in Na.Ka.No.539/2008/DSMS dated 07.06.2021 on the file of the first respondent and quash the same.

ORDER

Challenging the impugned eviction notice dated 07.06.2021, this writ petition has been filed to quash the same and to re-

allot and renew the lease deed with respect to the shops No.6, 10 and 11 at Poomalai Vaniga Valagam, J.N.Road, Thiruvallur. The contention of the petitioner is that she is ready and undertakes to pay rent to the respondent authority.

The learned counsel appearing for the first and second respondent would submit that already a writ petition in W.P.No.31327 of 2014 was filed by the petitioner and three others challenging the eviction order passed by the respondent and the above said writ petition was dismissed by this court on 03.02.2021 and further, an appeal in W.A.No.1290 of 2021 challenging the above order was also dismissed on 30.04.2021 by a Division Bench of this court and therefore, the petitioner cannot have any indulgence on the orders passed by the authority.

3. Heard both sides and I have perused the materials on record.

4. The petitioner was allotted the shops for lease in the year 2007 and it was extended up to the year of 2012. Subsequently, the first respondent had issued eviction order. The above said order was challenged by way of writ petition in W.P.No.13127 of 2014, which was dismissed by this court on 03.02.2021. Further, an appeal in W.A.No.1290 of 2021 filed as against the order passed in W.P.No.13127/2014 was also dismissed. Therefore, based on the orders passed by this court, the respondent had issued the present impugned orders to evict the shops.

5. Inview of the above and also considering the legal submissions, this court is of the view that there is no merits in the present writ petition and hence, not inclined to interfere with the impugned orders passed the first respondent.
