ORDER

This writ petition is filed for the following relief: "To direct the respondents to implement the 13th wage settlement dated 04.01.2018 and to revise the salary of the petitioner and to pay the difference amount of salary from 01.09.2016 till the date of retirement and to revise all the retirement benefits of the petitioner based on the revised salary as per 13th wage settlement dated 04.01.2018 and to pay the amount to the petitioners along with 12 percentage interest per annum from the date of retirement within the time frame fixed by this Court."

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner joined the service of the respondent corporation and retired on 30.09.2017 as a Senior Checking Inspector. Subsequently, the 13th Wage Settlement was entered into between the Management and the Trade Unions on 04.01.2018, pursuant to which the wages and pension were also revised with effect from 01.09.2016. Since the petitioner had retired on 30.09.2017, he is entitled to the difference in leave salary and gratuity from 01.09.2016 till the date of retirement and to revise the salary and all the retirement benefits of the petitioner as per the 13th Wage Settlement. Accordingly, the petitioner submitted a representation seeking

the difference in leave salary and gratuity from 01.09.2016 till the date of retirement and to revise the salary and all the retirement benefits of the petitioner as per the 13th wage settlement dated 04.01.2018. However, the said representation has not been considered so far.

In view of the above, the respondents are directed to pay the applicable differential amount in leave salary and gratuity from 01.09.2016 till the date of retirement and to revise the salary and all the retirement benefits of the petitioner, in accordance with the 13th wage settlement dated 04.01.2018, together with interest at the rate of 6% per annum, within a period of twelve weeks from the date of receipt of a copy of this order.

5.With the above direction, this Writ Petition stands allowed. No costs.
