ORDER

Pending the writ petition, the HR & CE Department has surveyed the property under the occupation of the petitioner and it is now stated by the learned Government Advocate, on written instructions, that the property, which is under the occupation of the petitioner is only 1465 sq.ft and on the said basis, the fair rent would be fixed, after giving an opportunity to the petitioner, to put forth his objections.

2.The fact that the petitioner is using the property for residential purposes, shall also be taken into account, while determining the fair rent. After conducting an enquiry and hearing the petitioner, orders shall be passed, within a period of eight weeks from the date of receipt of a copy of this order by the 3rd respondent.
