COMMON ORDER (Made by HULUVADI G.RAMESH, J.) The matter relates to granting financial upgradation to the second respondents in these writ petitions under the ACP Scheme with all consequential and attendant financial benefits and to consequently revise and refix the pension. The second respondent in each of these writ petitions got retired from service and in the entire career they earned one promotion and their grievance is that they have not been granted any financial upgradation under the ACP Scheme on completion of 24 years of service. They filed original applications before the Tribunal in O.A.Nos.1362 to 1364 of 2014 to grant such benefit to them, on the ground that similarly placed employees working in Doordarshan have been granted such benefit, on completion of 24 years of service.
The Tribunal, considering the facts and circumstances, directed the official respondents to consider their claim in the light of the orders of the Hon'ble High Court of Delhi in W.P.Nos.(C)18034 and 18035 of 2004 and grant them the second financial upgradation under ACP in the scale applicable to the next post in their promotional hierarchy, within a period of three months from the date of receipt of a copy of the order. Challenging the said common order, the present writ petitions have been filed by the Department.
2.When these writ petitions were taken up, the learned counsel for the petitioners/Department has produced a copy of the proceedings of the Director General, Prasar Bharati, Directorate General: All India Radio S-I(B) Section, Akashwani Bhawan, New Delhi, dated 23.08.2017, in which it is stated that in compliance of the Hon'ble High Court of Delhi's orders, the case of the second respondent in these writ petitions have been sent to Prasar Bharati for convening Departmental Screening Committee; thereafter minutes will be sent to the Ministry of Information and Broadcasting for approval of the competent authority. Relying upon the said proceedings, the learned counsel for the petitioners has submitted that the matter is under active consideration by M/s.Prasar Bharati.
3.Recording the above, the writ petitions are closed. No costs. Consequently the connected miscellaneous petitions are also closed.
