..Respondent(s) PRAYER - This Writ Petition is filed under Article 226 of the Constitution of India, seeking a Writ of Mandamus, directing the 2nd and 3rd respondents to conduct a survey of the pathway in Re.Sa.No.248/3A1 situated at Vemandampalayam village, Nambiyur Taluk, Erode District and consequently directing the 4th respondent to provide police protection by considering the petitioner's representation dated 21.11.2025 with in a stipulated time fixed by this court.

O R D E R

This Writ Petition has been filed seeking to direct the respondents 2 and 3 to survey the pathway, which according to the petitioner is owned by him, based on his representation, dated 21.11.2025, with the assistance of the 4th respondent, within a time frame to be fixed by this Court.

2. The petitioner had submitted a representation, dated 21.11.2025, for the aforesaid purpose. Since the same was not considered by the official respondents till date, the petitioner has filed this writ petition.

3. Mr.S.Arumugam, learned Government Advocate, accepts notice on behalf of the respondents 1 to 3 and Mr.V.Meganathan, learned Government Advocate (Crl.Side), accepts notice on behalf of the 4th respondent.

4. No prejudice would be caused to the respondents, if the respondents 2 and 3 are directed to survey the pathway of the petitioner's property morefully disclosed in the prayer to this writ petition, after hearing the objections, if any, from the neighbouring land owners as well as any other party whom they deem fit to put on notice, within a time frame to be fixed by this Court. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the pathway in question, the respondents 2 and 3 are directed to issue notice to the neighbouring land owners, and also to any other party, if they deem fit to put on notice.

(b) After receiving objections if any and after considering the same, the respondents 2 and 3 shall conduct survey of the pathway morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order.

(c) If the need arises for police assistance and on a request made by the respondents 2 and 3, the 4th respondent shall render police assistance for the effective implementation of this order.

(d) There shall be no order as to costs.
