2. The relief sought is for dispensing with the service of summons to the fourth respondent and an application has been filed under Order 14 Rules 8 of O.S. Rules read with Section 80(2) of the Code of the Civil Procedure.

3. The relief sought is not commensurate with Section 80(2) CPC, wherein pre-suit notice may be sought to be dispensed with.

4. Taking into consideration that leave to initiate the suit had been granted, the application is ordered, however not with respect to dispensing with issue of summons but with respect to notice under Section 80(2) CPC.
