ORDER

This petition has been filed to call for the records relating to Cr.No.444 of 2010 on the file of the first respondent and quash the same.

2. Heard the learned counsel for the petitioner; the learned Additional Public Prosecutor appearing for the first respondent/ State and the learned counsel appearing for the second respondent.

3. On the complaint lodged by one Poobalamoorthy, the first respondent police have registered a case in Cr.No.444 of 2010 for the offences under Sections 420 & 460 r/w 34 I.P.C. against the petitioners herein and others, challenging which, the petitioners are before this Court.

4. When the matter is taken up for hearing, the learned Additional Public Prosecutor submitted that the investigation in https://hcservices.ecourts.gov.in/hcservices/

Cr.No.444 of 2010 has been completed and final report is yet to be filed before the jurisdiction Court. This Court has perused the case diary and CD file, the charge sheet is ready and the same is yet to be filed.

5. In the light of the above, this petition is dismissed with a direction to the respondent police to file the final report before the jurisdiction court, within a period of four weeks from the date of receipt of a copy of this order. Liberty is given to the petitioner to raise all the points before the trial Court.

6. Though the offences are relating to land grabbing, the respondent police shall file the final report before the regular jurisdiction court and not before the Special Court for land grabbing cases, as the proceedings in the said court have been stayed by the Apex Court.
