ORDER
This Civil Revision Petition has been filed praying to set aside the docket order passed by the learned Special District Judge, Special District Court to deal with MCOP Cases, Villupuram, for initiating contempt proceedings based on the order dated 17.03.2026 made in E.P.NO. 49 of 2025 on the file of Special District Judge for MCOP Cases, Villupuram.
2.The revision petitioner herein is the first respondent; the respondents 1 & 2 herein are the petitioners 1 & 2 and the respondents 3 & 4 herein are the
respondents 2 & 3 in the Motor Accidents Claim Original Petition (MCOP) No.97 of 2019.
3.The case of the petitioner is that the deceased Mrs.Vijayalakshmi travelled as a passenger in a van bearing its Registration No.TN-22-BM-3414. While the van proceeding towards Chennai to Villupuram Highway near Vilangampadi Village, the driver of the van driven the vehicle in a rash and negligent manner and caused the accident, due to which, the said Vijayalakshmi sustained multiple injuries and died in the said accident. The respondents 1 & 2 filed an Original Petition before the Special District Court, Villupuram, seeking a compensation of Rs.25,00,000/- for a fatal accident occurred on 16.02.2019 at about 03:45 p.m. .
4.Heard both sides and perused the materials available on record. 5.On perusal of records, it reveals that the respondents 1&2 filed MACOP.No.97 of 2019 before the learned Special District Judge, Special District Court, Villupuram, seeking compensation of Rs.25,00,000/- together with interest at the rate of 12% p.a. from the date of petition till the date of realization. The respondents filed counter affidavit denying all the averments made in the petition. After perusing the records, the Tribunal allowed the petition by order dated 02.04.2025 awarding a compensation of Rs.19,74,000/-
to the respondents 1&2. Pursuant to the same, the respondents 1&2 filed Execution Petition No.49 of 2025 before the Special District Coiurt to deal with MCOP Cases. The Executing Court passed a docket order stating that "for appearance of Judgment Debtor finally. Memo of deposit of decretal money is filed by Judgment Debtor. At request by Judgment Debtor side for appearance time extended by 21.04.2026 finally NFA for further order will be passed including the contempt proceedings. Litigants/Advocates may appear through VC without any prior notice (Link is http://villupuram.dcourts.gov.in/hybrid-vc) Challenging the docket order passed by the Executing Court dated 17.03.2026, the petitioner/Transport Corporation has come forward with the present Civil Revision Petition.
6.Before the Executing Court, the revision petitioner/Transport Corporation deposited the entire decreetal amount. After depositing the entire decretal amount, the Executing Court directed the petitioner to appear before the Transport Corporation, failing which, contempt proceedings would be initiated which is under challenge.
7.On perusal of the records, it is further seen that the entire decretal amount was deposited, which is sufficient to proceed with EP.No.49 of 2025 pending before the MCOP, Villupuram. In spite of the proceedings with the Execution Application in the trial Court being erroneous. since the petitioner
complied with the entire decretal amount as per the order passed by the Trial Court dated 17.03.2026, the order initiating contempt proceedings is liable to be set aside.
8.In such view of the matter, the impugned docket order dated 17.03.2026 made in E.P.No.49 of 2025 passed by the learned Special District Judge, Special District Court to deal with MCOP Cases, Villupuram, is hereby set aside. 9.Accordingly, this Civil Revision Petition is allowed.
