ORDER
This Writ Petition is filed seeking for Writ of Mandamus directing respondent Nos.1 to 4 not to grant any permission for opening of the new college in Survey No.59/1 in Sittampoondi, Gingee, Villupuram District by considering the petitioners representation dated 24.05.2022.
2. Petitioner as the hereditary Muthavalli of Hasarth Syed Musthafa Sha Awlia Darga Waqf has filed the above Writ Petition stating that the land in
Gingee Taluk, Sittampoondi, Villupuram District, in G.S.No.164 Survey No.59/1, with an extent of land 6.67 acres, falls under the Tamil Nadu Waqf Board. As the fifth and sixth respondents along with the Minister of Minorities Welfare, Non Resident of Tamils Welfare, Refugees & Evacuees and Wakf Board, Government of Tamilnadu, conducted inspection for the purpose of establishing Government Arts and Science College, on 19.05.2022, in the above mentioned subject Survey number, the petitioner submitted a representation to the respondent Nos.1 to 4 not to grant any permission for opening of a new college in the above said Survey Number. As no action was taken by the respondents, the petitioner preferred this Writ Petition with the above prayer.
3. Learned counsel for the petitioner submitted that though a larger relief is prayed, it would suffice if a direction is issued to respondents to consider the petitioner's representation dated 24.05.2022, within a time frame fixed by this Court.
4. Considering the limited prayer of the learned counsel for the petitioner,
without expressing any opinion on the merits of the case, a direction is issued to the third respondent to consider the petitioner's representation dated 24.05.2022, by affording an opportunity of hearing to the petitioner, and to pass appropriate orders on merit and in accordance with law, preferably within a period of eight weeks, from the date of receipt of copy of this order.
5. With the above directions, this Writ Petition is disposed of. No costs. Consequently, connected miscellaneous petition is closed. 10-03-2025 jai Index:Yes/No Speaking/Non-speaking order Internet:Yes
