..Respondent PRAYER : Writ Petition has been filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the respondent herein to receive the Application of the petitioner dated 02.05.2024 in Form CCPA along with the prescribed fee through on-line for the grant of Auto Rickshaw Permit to operate the vehicle within radius of 30K.M. Distance from Salem Town Old Bus Stand, Salem and to consider the same.

ORDER

The writ petitioner seeks for issuance of Writ of Mandamus to direct the respondent to receive the Application of the petitioner dated 02.05.2024 in Form CCPA along with the prescribed fee through on-line for the grant of Auto Rickshaw Permit to operate the vehicle within radius of 30K.M. Distance from Salem Town Old Bus Stand, Salem and to consider the same.

2. The learned counsel for the petitioner invites my attention to the order dated 10.04.2024 in W.P. No.9394 of 2024, where this Court in almost identical circumstances disposed of the Writ Petition, directing the respondent to receive the Application of the writ petitioner alongwith prescribed fee for grant of Auto Rickshaw Permit and consider the same on merits.

3. I have no hesitation to follow the said order passed by this Court which is in fact has already recorded a similar order earlier passed in W.P. 2/4

No.18034 of 2020 dated 11.12.2020.

Accordingly, this Writ Petition is allowed with a direction to the respondent to accept the Application of the petitioner along with prescribed fee, through on-line mode, for grant of Auto Rickshaw Permit to operate the vehicle within radius of 30K.M. Distance from Salem Town Old Bus Stand, Salem and consider the said Application purely on merits and in accordance with law and pass appropriate orders, within a period of eight weeks from today. No costs.
