Writ Petition is filed under Article 226 of the Constitution of India to issue a writ of certiorarified mandamus to call for the records with regard to the impugned order passed by the third respondent vide his office letter No.Na.Ka.No.3230/U2/2020 dated 15.04.2021 and quash the same and consequently direct the respondents 1 to 3 to reimburse the medical expenses of Rs.3,04,578/- incurred by the petitioner for taking medical treatment to him at M/s.Girishwari Hospital, Chennai with interest at the rate of 9% from 25.01.2020 i.e. the date of payment made by the petitioner to the hospital till date of reimbursement made to the petitioner within the time fixed by this Court.

ORDER

This Writ Petition has been filed challenging the impugned order passed by the third respondent vide his office letter No.Na.Ka.No.3230/U2/2020 dated 15.04.2021 and consequently to direct the respondents 1 to 3 to reimburse the medical expenses of Rs.3,04,578/- incurred by the petitioner for taking medical treatment to him.

2. The petitioner who is working as a Junior Engineer and a beneficiary of New Health Insurance Scheme have taken treatment for his ailment at Girishwari Hospital, Chennai, for a period of five days. The respondent have rejected the claim of the petitioner stating that the petitioner has not taken treatment in an accredited hospital.

3. Since the District Collector, who is the appropriate authority has who have to make recommendations with regard to the claim for reimbursement, the petitioner is at liberty to make a fresh application to the second respondent and on receipt of the same, the second respondent shall pass appropriate orders in the light of the earlier judgment passed in this regard and the earlier recommendations made by the second respondent himself, within a period of six weeks from the date of receipt of a copy of this order.

4. With the above observations, this writ petition is disposed. No costs.
