O R D E R

(By J.Nisha Banu,J.) This Writ Petition has been filed for a direction to respondents to issue community certificate to the petitioners belonging to "Bandi and Godda" community by taking into account petitioners' representation dated 06.12.2023.

2. Mr.R.Kumaravel, learned Additional Government Pleader takes notice for the respondents. By consent, the Writ Petition itself is taken up for final disposal at the admission stage. 3/6

3. It is the case of the petitioners that they all belong to "Bandi and Godda" community, which is a marginalized community. The Government had issued a circular dated 29.09.2005 to all the District Collectors to issue a community certificate belonging to Bandi and Godda community without any delay. Though some of the relatives of the petitioners were issued community certificates, others were denied arbitrarily. As a result, the 1st generation students aspiring for higher studies are not in a position to have benefits. It is further case of the petitioners that on the basis of an Anthropological Report dated 28.11.2021 submitted after a thorough enquiry, 33 persons were issued community certificates and the said benefit has not been extended to the petitioners. Though the petitioners have given a representation dated 06.12.2023 to the respondents for issuance of community certificate, there is no response till now. Hence, the petitioners are before this Court.

4. Learned Additional Government Pleader appearing for the respondents stated that a reasonable time may be granted to the respondents for considering and passing appropriate orders on the representation of the petitioner.

Taking note of the fact that the petitioners had given representations as early as on 06.12.2023, prior to two years, the petitioners are directed to make fresh representations to the 1st respondent / District Collector, by enclosing a copy of this order and the previous representation dated 06.12.2023, within a period of two weeks from the date of receipt of a copy of this order. On receipt of the fresh representation, the 1st respondent is directed to consider the representations of the petitioners, by giving an opportunity of personal hearing to the petitioners and pass appropriate orders in respect of issuance of community certificates to the petitioners in accordance with law within a period of eight weeks thereafter.

6. With the above direction, this Writ Petition is disposed of. No costs.
